Welcome to BirthdayRizz (the “Service”), operated by Birthday Rizz LLC (“Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the BirthdayRizz website and related services (the “Website”), including the creation and delivery of online birthday invitations via email and SMS.

By accessing or using the Website, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of the Service

BirthdayRizz allows users (“Hosts”) to create online birthday invitations and send them to invited guests (“Guests”) via email and/or SMS text message. Hosts may input Guests’ email addresses or mobile phone numbers solely for the purpose of sending invitations and receiving responses.

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements.

3. User Responsibilities

3.1 Hosts

As a Host, you agree that:

  • You have permission to provide the email addresses and/or mobile phone numbers of Guests.
  • You will use the Service only for personal, non-commercial invitation purposes.
  • You will not use the Service for spam, harassment, or unlawful communications.

3.2 Guests

As a Guest, you may receive invitations via email or SMS. You are not required to respond, and you may opt out of SMS messages at any time by replying STOP.

4. SMS Communications

By entering a mobile phone number, Hosts represent that they have obtained the Guest’s consent to receive SMS invitations. Message and data rates may apply.

Guests may opt out of SMS messages at any time by replying STOP to any text message. Once opted out, no further SMS messages will be sent to that number unless the Guest re-subscribes.

5. Privacy and Data Use

Birthday Rizz LLC respects your privacy.

  • We use Guest email addresses and phone numbers solely to send invitations and related responses.
  • We do not sell, rent, share, or disclose Host or Guest email addresses or phone numbers to third parties.
  • We implement reasonable security measures to protect user data.

6. Acceptable Use

You agree not to:

  • Use the Website in violation of any applicable U.S. federal, state, or local law.
  • Attempt to gain unauthorized access to the Website or its systems.
  • Interfere with or disrupt the integrity or performance of the Service.

All content, branding, trademarks, and software associated with the Website are the property of Birthday Rizz LLC or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without prior written consent.
